1. The personal data controller<\/strong> \u2013 in accordance with Article 4 point 7 of the GDPR Regulation is NEXT MOBILE P.S.A. (formerly Globitell Wholesale Sp. z o.o. Sp. k.) with its registered office in \u0141\u00f3d\u017a, ul. \u0141\u0105kowa 3\/5 lok. 7, 90-562 \u0141\u00f3d\u017a, entered into the Register of Entrepreneurs of the National Court Register under the KRS number 0001084040, Tax Identification Number (NIP) 7282820933, National Business Registry Number (REGON) 368809400, share capital of PLN 162,500.00; <\/p>\n\n

2. GDPR <\/strong>\u2013 Regulation (EU) 2016\/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95\/46\/EC (General Data Protection Regulation); <\/p>\n\n

3. Website<\/strong> \u2013 website of NEXT MOBILE P.S.A. (formerly Globitell Wholesale Sp. z o.o. Sp. k.) with its registered office in \u0141\u00f3d\u017a; <\/p>\n\n

4. Company <\/strong>\u2013 NEXT MOBILE P.S.A. (formerly Globitell Wholesale Sp. z o.o. Sp. k.) with its registered office in \u0141\u00f3d\u017a; <\/p>\n\n

5. User <\/strong>\u2013 a natural person who has full legal capacity, a natural person conducting business activity, a legal person or an organizational unit that is not a legal person, to which special provisions grant legal capacity, who uses the Company’s website. <\/p>\n\n

II. General provisions<\/strong> <\/h4>\n\n

1. The Company respects the privacy of users and visitors to the Company’s websites.<\/p>\n\n

2. This document defines the practices used by the Company regarding personal data, the methods of collecting it, the purposes for which it may be used and the persons for whom the data is intended. <\/p>\n\n

3. Taking into account the need to protect the privacy of Users, the Administrator in its business activities complies with the obligations arising from applicable provisions on the protection of personal data, in particular the General Data Protection Regulation (EU) 2016\/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95\/46\/EC, hereinafter referred to as the GDPR. <\/p>\n\n

4. The Administrator declares that it processes the User’s personal data while maintaining appropriate technical and organizational measures that ensure such protection. <\/p>\n\n

5. The personal data controller, while ensuring appropriate data security in accordance with applicable standards and knowledge, is not able to exclude the possibility of personal data being stolen by unauthorized persons.<\/p>\n\n

6. The User is entitled to contact the Personal Data Controller in writing at the address indicated in point 1.1 or by e-mail to iod@glwh.pl<\/a>. <\/p>\n\n

7. The User is entitled to contact the owner of the Website in writing at the address indicated in point 1.1 or by e-mail to dok@nextmobile.pl<\/a>. <\/p>\n\n

8. In case of technical problems, the User is entitled to contact us via e-mail at noc@nextmobile.pl<\/a>. <\/p>\n\n

9. The Company is the owner of the Website and a service provider under the provisions of the Act of 26 August 2002 on the provision of services by electronic means. <\/p>\n\n

III. User’s personal data<\/strong> <\/h4>\n\n

1. The Company will collect your personal data for specific, clearly defined, and legitimate purposes. The Company will not treat your personal data in a manner incompatible with those purposes. <\/p>\n\n

2. The Company undertakes to collect only information that is adequate, relevant, and not excessive for the purpose for which it is collected. If necessary, the Company will take all reasonable steps to verify the accuracy and currency of the personal data collected. <\/p>\n\n

3. When using the website, the User is required to provide personal data only when necessary to use a given functionality of the website. The User will be informed of the requirement to provide personal data. <\/p>\n\n

4. Providing personal data by the User is voluntary, but necessary in order to use the website’s functionality. <\/p>\n\n

5. When collecting personal data, the Company informs the person concerned at the time of or before collecting the data, and at least before using the data for a specific purpose. <\/p>\n\n

6. The Administrator processes Users’ personal data for the period necessary to perform the task resulting from the submitted application, e.g. in order to process an information contact. <\/p>\n\n

7. The Administrator stores Users’ contact details for the purposes of providing services and marketing products and services, but only until it is established that an objection has been raised to their processing or consent has been withdrawn – in the case of processing personal data based on the User’s prior consent. <\/p>\n\n

8. NEXT MOBILE P.S.A. (formerly Globitell Wholesale Sp. z o.o. Sp. k.), taking into account Article 6 of the GDPR, processes Users’ personal data for the following purposes: <\/p>\n\n

  • access to website functionality; <\/li>\n\n\n\n
  • performance of the service provision agreement, in particular ensuring the correct operation of the service and ensuring network security; <\/li>\n\n\n\n
  • realization of the legitimate interests of the Controller or external entities; <\/li>\n\n\n\n
  • fulfilling the legal obligation incumbent on the Administrator, resulting from legal provisions or decisions of state authorities; <\/li>\n\n\n\n
  • marketing and promotion of services and goods provided by NEXT MOBILE P.S.A. (formerly Globitell Wholesale Sp. z o.o. Sp. k.) or other entities cooperating with NEXT MOBILE P.S.A. (formerly Globitell Wholesale Sp. z o.o. Sp. k.). <\/li>\n<\/ul>\n\n

    9. The Administrator shares the User’s personal data with other entities only for the purpose resulting from the use of the Website. <\/p>\n\n

    10. The Administrator is entitled to make the User’s personal data available to entities authorized to receive them under the law. <\/p>\n\n

    11. The Administrator, its employees and entities operating the Website have access to the personal data provided by the User. <\/p>\n\n

    12. NEXT MOBILE P.S.A. (formerly Globitell Wholesale Sp. z o.o. Sp. k.) reserves the right to transfer personal data to entities processing the User’s personal data on behalf of the Controller, including service providers supplying P.S.A. (formerly Globitell Wholesale Sp. z o.o. Sp. k.) with technical, organizational or IT solutions, marketing service providers, accounting, legal and advisory service providers; other personal data controllers who process data on their own behalf, including companies conducting postal and courier activities, banks and institutions conducting payment activities. <\/p>\n\n

    IV. User Rights<\/strong> <\/h4>\n\n

    1. The User whose personal data is processed is entitled to request from the Administrator: <\/p>\n\n

    • access to your personal data; <\/li>\n\n\n\n
    • rectification of personal data if it is incorrect; <\/li>\n\n\n\n
    • supplementing personal data if it is incomplete; <\/li>\n\n\n\n
    • deletion of personal data in the cases indicated in Art. 17 GDPR; <\/li>\n\n\n\n
    • restrictions on the processing of personal data in the cases indicated in Art. 18 GDPR; <\/li>\n\n\n\n
    • transfer your personal data; <\/li>\n\n\n\n
    • withdraw consent to the processing of personal data at any time. <\/li>\n<\/ul>\n\n

      2. Withdrawal of consent referred to in point 4.1 letter g does not affect the lawfulness of the processing of personal data carried out on the basis of previously expressed consent. <\/p>\n\n

      3. The User has the right to object to the processing of his or her personal data. <\/p>\n\n

      4. The User also has the right to lodge a complaint with the President of the Personal Data Protection Office if he or she considers that the processing of his or her personal data violates the provisions of the GDPR. <\/p>\n\n

      5. NEXT MOBILE P.S.A. (formerly Globitell Wholesale Sp. z o.o. Sp. k.) collects information regarding the User’s browsing of the Website, including the IP address, date and time of the visit to the website. <\/p>\n\n

      6. The information referred to in point 4.6 is not used to identify the User. The above information is used solely for the purpose of maintaining statistics by NEXT MOBILE P.S.A. (formerly Globitell Wholesale Sp. z o.o. Sp. k.) and improving the operation of the Website. <\/p>\n\n

      7. The Website uses Google Analytics, Google AdWords, and other analytical tools that enable the User to use the Website. <\/p>\n\n

      V. Data security<\/strong> <\/h4>\n\n

      1.The Company has taken measures to ensure the confidentiality, security and integrity of your personal data. Access to personal data is limited to those who need to know it and who are required to comply with this policy. <\/p>\n\n

      2. The Company attaches great importance to ensuring that your personal data is not changed, violated or misused by third parties who are not authorized to access the data. <\/p>\n\n

      VI. Minors <\/strong><\/h4>\n\n

      In general, the Company’s websites are not intended for use by minors under the age of eighteen (18). We discourage minors from providing any information or personal data without parental consent. <\/p>\n\n
